Nickolas Stevens, REALTOR® · First Home Utah (a website operated by Nick Stevens under Century 21 Everest) (“we,” “us,” or “First Home Utah”) operates firsthomeutah.com (the “Site”) and provides Utah real estate services to first-time and repeat homebuyers and sellers (the “Services”). This Privacy Policy describes what information we collect, how we use it, and the choices you have. By using the Site or Services, you agree to this Policy.

1. Information we collect

Information you give us directly

Contact information — name, email, phone, mailing address — when you submit a form (consultation request, home value estimator, mortgage calculator, market report, open house sign-in, newsletter signup).
Property details — square footage, beds, baths, condition, lender, transaction stage — when you request a valuation or work with us as a client.
Optional personal context — family details, occupation, anniversaries, dreams and goals — when you choose to share so we can serve you better (Ninja Selling “FORD” framework).
Account credentials — for the private CRM, if you are an authorized agent.

Information collected automatically

Usage data — pages viewed, browser, device, IP address, referrer.
Cookies and similar technologies — see Section 7.
Email engagement — whether a marketing email was opened or a link clicked, via Postmark.
Inbound SMS — messages you send to our business phone number, via Quo (formerly OpenPhone).

Information from third parties

Lead providers — when you submit your information through ProAgent Websites / utahshortsale.com or another partner real-estate lead source, that platform forwards the lead to us.
Public records and MLS data — used to enrich property research; this is not personal data about you unless you are the owner of the property in question.

2. How we use information

Respond to your inquiries and provide the real estate services you requested.
Send you the report, estimate, or guide you specifically asked for (e.g. the home valuation email).
Follow up with you about your home search, sale, or related questions.
Send market updates, listing alerts, or newsletters when you have explicitly opted in.
Operate, secure, and improve the Site and CRM.
Comply with legal obligations, including real estate licensing recordkeeping under Utah law.

3. SMS and text messaging (TCPA)

Text messaging consent terms

We send SMS text messages only when you have affirmatively opted in by checking the SMS consent box on one of our forms or by texting us first.
By opting in, you agree to receive recurring text messages from First Home Utah (Nickolas Stevens, Licensed Utah REALTOR®) about your real estate inquiry, market updates, listing alerts, scheduling, and related real estate matters.
Message frequency varies. You may receive messages in response to your specific requests, plus periodic updates if you opted in to those.
Message and data rates may apply. Carrier fees are your responsibility; we charge nothing for SMS.
Reply HELP for help. Reply STOP at any time to unsubscribe; we will stop sending texts and send one confirmation message.
Consent to receive SMS is not a condition of any purchase, service, or transaction.
We do not sell mobile information to third parties. We do not share phone numbers with non-affiliated third parties for their own marketing purposes. Mobile information is only shared with the technology vendors necessary to deliver the SMS service (see Section 5) and only as required to operate the service.
SMS data is retained as needed to respond to your inquiry and to comply with our legal obligations. You may request deletion at any time (see Section 9).

4. Legal basis for processing

We process your personal information based on (a) your consent (for marketing emails and SMS), (b) our need to perform a contract or service you requested (responding to your inquiry, providing the report you asked for, representing you in a transaction), and (c) our legitimate interests in operating, securing, and improving the Site.

5. Third-party processors and service providers

We use the following vendors to operate the Site. Each receives only the data necessary to provide its service and is contractually required to protect it:

Vercel — Site hosting. Privacy policy
Supabase — Database for contacts, leads, and transaction records. Privacy policy
Postmark (ActiveCampaign) — Transactional and broadcast email delivery, including bounce / open / click tracking. Privacy policy
Quo (formerly OpenPhone) — Business phone and SMS service. Privacy policy
Google Workspace — Inbound email and calendar. Privacy policy
Google Analytics — Aggregated usage analytics. Privacy policy
Mapbox — Map tiles and geocoding for listing pages. Privacy policy
Calendly — Consultation scheduling. Privacy policy
Sentry — Application error monitoring. Privacy policy
FRED (Federal Reserve Economic Data) and Realtor.com — Source feeds for mortgage rates and market statistics. These services do not receive your personal data.

We may also share information with: (a) lenders, title companies, inspectors, and other transaction parties when you have engaged us to represent you, only as needed to complete that transaction; (b) Century 21 Everest, our brokerage, for required licensing recordkeeping; and (c) legal authorities when required by law.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Email marketing and unsubscribe

We send marketing emails (market updates, listing alerts, newsletters) only to recipients who have explicitly opted in. Every marketing email contains a one-click unsubscribe link in the footer. We honor unsubscribe requests immediately by suppressing further marketing email to that address. Transactional emails directly tied to a service you requested (e.g. the home valuation report you asked for) are not subject to the marketing unsubscribe.

7. Cookies and tracking technologies

The Site uses cookies and similar technologies for: (a) essential functions such as session management and security; (b) preferences such as remembering your filter selections; and (c) analytics via Google Analytics to understand which pages are useful. You can block or delete cookies through your browser settings; some Site features may not work without them.

8. How long we keep information

We keep contact records, transaction records, and required real estate documentation for as long as Utah real estate law requires (currently 7 years after a transaction closes). We keep marketing-list records until you unsubscribe. We keep raw form submissions and message archives for up to 3 years for audit and dispute resolution.

9. Your rights and choices

Access — request a copy of the personal information we hold about you.
Correction — request that we update inaccurate information.
Deletion — request that we delete your information, subject to any records we are required by law to retain.
Email opt-out — use the unsubscribe link in any marketing email, or contact us.
SMS opt-out — reply STOP to any text from us, or contact us.
Do Not Sell or Share My Personal Information — we do not sell or share personal information for cross-context behavioral advertising, and we do not sell mobile information (see Section 3).

10. Security

We protect your information with industry-standard administrative, technical, and physical safeguards including encrypted database connections, row-level security, restricted internal access, and secrets managed via the deployment platform. No system is perfectly secure; we cannot guarantee absolute security.
