These Terms of Service (“Terms”) govern your use of firsthomeutah.com (the “Site”) and all related tools and services provided by Nickolas Stevens, REALTOR® · First Home Utah (a website operated by Nick Stevens under Century 21 Everest) (“we,” “us,” or “First Home Utah”). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. Services

The Site provides Utah real estate information and lead-generation tools, including: (a) the home value estimator at /utah-home-value; (b) the mortgage calculator at /utah-mortgage-calculator; (c) county market reports at /utah-market-report/[county]; (d) open house sign-in pages; (e) consultation requests; (f) blog content; and (g) brokerage services performed by Nickolas Stevens, Utah licensed real estate agent (DRE #13980555-SA00) under Century 21 Everest.

2. Information is not advice

Important disclaimers about the tools on this Site

The home value estimator is not a Comparative Market Analysis (CMA) or appraisal.It is a directional estimate based on county-level median price per square foot from Realtor.com data. Your home's actual market value can differ materially. Do not rely on it for any financial decision.
The mortgage calculator is not a loan offer, pre-approval, or quote. Calculations are based on the inputs you provide and current data sources we cache. Actual rates and terms vary by lender, credit, income, debt-to-income ratio, property type, and market conditions at the time you lock.
Market reports are aggregate statistics, not personalized advice. Local micro-market conditions (neighborhood, school, lot, condition) can deviate significantly from county-level numbers.
Nothing on the Site constitutes legal, tax, financial, accounting, or investment advice. Consult licensed professionals for those matters.
Real estate brokerage services are performed only after we execute a written representation agreement with you. The Site itself does not create an agency relationship.

3. Listings and property information

Listing details, property photos, MLS data, and other property information shown on the Site are deemed reliable but not guaranteed. The Site is not the official MLS feed. You should verify all material facts (square footage, lot size, school assignments, HOA, taxes) independently before relying on them. All real estate advertised on the Site is subject to the Federal Fair Housing Act, which makes it illegal to advertise any preference, limitation, or discrimination based on race, color, religion, sex, disability, familial status, or national origin.

4. Use of the Site

You agree that you will not:

Submit false, misleading, or fraudulent information through any form.
Submit information about another person without their explicit permission.
Use the Site, our forms, or our SMS / email infrastructure to send unsolicited communications, spam, or harassment.
Scrape, harvest, or otherwise extract bulk data without our prior written consent.
Reverse-engineer, decompile, or attempt to bypass any security mechanism.
Use the Site in violation of any applicable law, including Utah real estate licensing law and the federal TCPA.

5. CRM accounts

The CRM at /crm-* URLs is private and accessible only by authorized agents. You are responsible for protecting any account credentials issued to you and for activity that occurs under your account. Notify us immediately at nick.stevens@firsthomeutah.com if you suspect unauthorized access.

6. Intellectual property

All Site content — text, design, code, blog posts, fliers, valuation algorithms, market analyses, photographs, logos — is owned by First Home Utah or licensed to us, and is protected by copyright, trademark, and other intellectual property laws. Limited license: you may view and print pages for personal, non-commercial use. You may not reproduce, redistribute, or create derivative works for any commercial purpose without prior written consent. Third-party trademarks (Century 21, REALTOR®, MLS, Quo, Postmark, etc.) are the property of their respective owners.

7. User-submitted content

When you submit content through a form (open house sign-in message, comment, etc.), you grant us a non-exclusive, royalty-free, worldwide license to use that content as needed to provide the Services, respond to your inquiry, and operate the Site. You represent that the content does not infringe any third-party right and is not false, defamatory, or unlawful.

8. Third-party services and links

The Site embeds or links to third-party services (Mapbox, Calendly, Google, Postmark, Quo, MLS-feed providers, lender partners). We are not responsible for the content, accuracy, terms, or privacy practices of any third party. Your interactions with third-party services are governed by their own terms.

9. No warranty

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRST HOME UTAH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF YOUR USE OF THE SITE OR THE TOOLS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. Indemnification

You agree to indemnify and hold harmless First Home Utah and its affiliates from any third-party claim arising out of (a) your violation of these Terms; (b) your submission of false or fraudulent information; or (c) your misuse of the Site, the SMS or email service, or any tool provided through the Site.

12. Governing law and venue

These Terms are governed by the laws of the State of Utah without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the jurisdiction of those courts.
